Deed of Sale of Motor Vehicle

Every time we do have a sale transaction, especially those involving real properties and motor vehicles, we need to make sure that the property will be transferred in our name after we have made the payment or simultaneously when the payment is made.
How is this done? Well, the seller or transferor of the property must be made to execute or sign a Deed of Sale. This instrument will be the basis, in case of real property, of the Register of Deeds to cancel the title of the former owner in favor of the buyer or transferee of the property. The Deed of Sale will contain the name of the seller, the terms and conditions of the sale which includes the selling price, the manner of payment of capital gains tax, and the date the sale is consummated. The document must be notarized by a Notary Public. In the Philippines, the notary public should be a Lawyer. Please also take note that if the seller of the property is married, the consent of his/her spouse is required in the document.

You can draft the deed of sale yourself if you want that the notarial fees would be a lot cheaper than when it is the lawyer who will draft the document. Here is a sample of a Deed of Sale:

I am the third owner of motor vehicle, I buy it from the 2nd owner and he gave me an open deed of sale from the day i purchase until now ididnt sign it and even no notary, what is the consequense to be charge if im got captured by the law enforcer, i want a proper legal documents, please advice

  6. DM, you need to have that Deed of Sale notarized because legally you are not the owner of that. If you get caught without ownership documents, the law enforcer can presume it's carnapped.

    1. If after the seller signed above the portion VENDOR on the blank deed of sale; after he died, a person filled it up making him the buyer. Is it legal? Is it a falsified document? When is the document considered executed?

    1. It must be in coMpany's name and ask for official receipt. The president can encash the check and use it for personal use if it is in his name.

Hello, I'm buying a second hand car but the name in the OR and CR is still that of the first owner of the car while the person I am buying the car from is supposed to be the second owner but failed to transfer the car ownership under him. He says that transfer of ownership is expensive, like 20K pesos so he didn't do it since this is, according to him, not necessary? is he right? So what needs to be done and what proof will I have that he will receive a certain amount of money from me, does he issue an official receipt? is the OR and CR enough? who will be named vendor, the current owner/seller or the first owner whose name is still the one that appears in the OR and CR? what documents are needed to show that I am the owner of the car? Can you place a phrase in the deed of sale that the vendor will have to refund all the money in case the car is found to be stolen?

    1. He is not right. Transfer of the ownership is necessary as this is your proof in case your possession of the vehicle is questioned. You need to obtain from him the Deed of Sale which the previous owner signed as proof that the said car was really sold to him. Then between you and this seller, you need the Deed of Sale also before you pay him. The Deed of Sale is enough proof of payment. You can add the phrase on refund in the Deed of Sale if you want to.

    My sasakyan ako na bibilhin tapos tanong ko lang ano yung mga documents na kukunin ko sa kanya aside from the OR and CR. Then ung sa Deed of Sale sino ba dapat mg babayad dun ang seller o ang buyer and how much po ang mababayad kaya if 100k ang price ng vehicle. Kasi dami ko babayaran pa pati ang registration sa vehicle kasi expired na..

  19. Hi What are the taxes and fees involved in selling a motored vehicle for the buyer and the seller? For the buyer, I assume there will be docs stamps and transfer tax? at what percent? How much is the estimated cost on top of the purchase for the taxes and fees? Thanks!

      kung ang OR/CR ay nasa 1st owner pa. ang deed of sale na nakapirma dapat is yung 1st owner - ang Seller is yung 1st owner. Dahil un ang nakalagay sa OR/CR mo. kaya magpasama ka sa friend mo (2nd owner) dun sa 1st owner na pirmahan yung deed of sale.

    1. ito lang dapat gawin mo. mag pagawa ka ng deed of sale sa father mo or ikaw ang gumawa send mo sa knya sa email then e print nya , after purmima ng father mo sa deed of sale. ipadala nya sayo thru LBC. wala ka ng problema.

      Dahil kung sino ang nakalagay na name sa OR/CR yun ang Seller.

  27. Goodevening po... if i may ask for advice regarding sa situation ko. Pinabenta ng mother ko sakin who is an immigrant now, ung kotse ng father ko since ako nandito sa Pinas.. I sold it to my supervisor at work, He paid the monetary value to me and i handed over the OR CR and the car over to him HOWEVER,. we haven't signed a deed of sale yet kase we were waiting na makauwi mother ko to sign the deed of sale herself. So the car was with the new owner for 6 months now.... this month, umuwi mother ko dito sa Pinas, but the engine of the car finally gave in and needs an overhaul. The buyer now is asking me if i could help him by giving him any monetary amount to help pay for the repairs. May obligation parin po ba ako to pay him any amount kase wala pang deed of sale between us? Magpapa sign pa ako ng deed of sale sa kanya. please advice. thank you

    1. wala ka ng obligation, In Good Faith naman ang naging transaction nyo kahit wala pang deed of sale, dahil hawak mo pa naman ang OR/CR. problema nga lang baka ibalik sayo at bawiin yung binayad sayo. pagusapan nyo nalang ng maayos. but for me hindi mo need maglabas ng pera pang pagawa dahil siya na ang gumamit ng sasakyan.

  28. Hi, bibili po ako ng second hand car. yung OR and CR po naka pangalan sa Company kung saan nagttrabaho yung Seller. Pero yung deed of sale, naka pangalan sa Seller. Magkaka problema ba yun sa part ko as Buyer? Complete naman daw lahat ng documents related sa car.

    1. magkakaproblema ka dyan kung hindi pa naka transfer sa kanya. yun kasi ang proof mo yung original Title un ang panghahawakan mo. kung sa baga collateral. and dapat ipakita nya sayo yung original title sa 1st Owner.

    1. Deed of sale ang kailangan mo, maliit lang magagastos mo dyan. seller yung kuya ng asawa mo then ikaw yung buyer. ilagay mo sa price kalahati ng presyo ng motor para mas maliit babayaran mo sa notary. sa pag transfer naman ng name mo LTO na bahala dun. mura lang pa transfer yan. 1k-2k max.

  32. padala mo nalang yung new deed of sale sa abroad..then kapag napirmahan na nya.. ipadala nya ulit sayo.. kahit 400K lang ilagay mo sa deed of sale , tito mo naman yun.. wala na pakialam BIR dun.

    kapag pinadala mo yung deed of sale make sure naka pirma ka.

  38. Hi! Nakabili po ako ng sasakyan na may problema. Ganito po ang kwento: Bali yung orig na may ari, ginawa nyang collateral yung sasakyan sa isang financing company. Tapos ang ginawa nya... binenta nya sa iba. Kaso di nya nabayaran yung utang nya kaya natalo sya sa kaso na lumabas lang ang desisyon ng korte nitong 2016. Binili ko yung sasakyan dun sa isa sa mga nakabili rin ng sasakyan. Open deed of sale sya so, nagkapirmahan lang kami ng sulat kamay kasi dahilan nila open DOS naman daw. tiwala lang ako at naawa din sa matanda dahil may sakit. During that time, nagcheck kami sa LTO at wala nga syang alarm. (Oct. 2015). ngayon di ko na sya maipatransfer sa pangalan ko kasi natalo ang orig na may ari sa kaso. Ayaw ibalik ng pinagbilhan ko kasi ang dahilan nya.. di naman daw nakanotaryo yung kasulatan namin at ng ibenta nya daw ang sasakyan e wala raw alarm sa lto. ano po ang pwede kong gawin? nagkaroon napo kami ng pirmahan sa barangay na ibabalik ang pera ko kaso nitong huli dahil wala silang maibayad, nakikipagcontest sila at naghamon na magdemanda daw ako.   39. Hello, I have a question that you might get to answer. Im buying a 2nd hand car and the seller has the car under his 14yr old sons name, he has no govt ID. What will the deed of sale look like? Will it be under a minors name? Will It need an authorization later from the father?

    My other question is having the deed of sale notarized. Is there a need for both parties to be present when it will be notarized or can it be notarized without the seller and buyer present?

Hello po ipapaso po sakin ng pinsan ko yung motor na hinuhulugan nya. bale po downpayment lang at 2 buwan na hinulog nya ang binayaran ko sakanya at ako na po ang mag papatuloy ng natitirang 34 months na bayarin buwan buwan. ang tanong ko lang po pede po ba itong deed of sale gamitin ano po ang ilalagay ko sa sum or amount or may kailangan pa bo akong palitan na installment ang ilagay ko sa deed of sale. maraming salamat po.

  46. Hello po. Bumili po ako ng motorcycle. Alam ko naman po na kailangan po ung deed of sale and it should be notarized. Pero d pa po namen napanotary kasi po mali ung signature ng previous owner. Instead po na sa vendor sya pumirma, ung vendee po pinirmahan nya.Paano po kaya un? Is it possible po ba na interchange na lang ung vendee at vendor by snow paint? Bali 3rd hand po kasi kami pero sa signatory pa rin po dun sa deed of sale is the real owner.

    I bought a car JIMNY 2002 from davao. The seller said that the unit was a surplus from Japan. It has no legal papers since it was assembled in Davao. The registration will be then made by him, and it will take 45days to have the papers.
    Now my problem is, he hasn't made a Deed of Sale for me since the unit wasn't under his name. He only gave me the acknowledgement receipt that stated the unit name, chassis number, year model and color, with no OR/CR yet. Acknowledgement paper is the only proof I have from him since he said he's an eligible seller, in which I trusted him (based on his FB page and friends).
    Please give me an idea of what to do with him, since he's asking for another payment for the registration. We already agreed that payment will be issued if registration papers are on my hand. But now he said that, he cannot shoulder the payment.
    My question is, should I do the registration myself? What are the requirements since the unit has no papers from Japan? Please help.

  49. Hi po. Binebenta ko na po ang second hand na motor ko. Ang nakalagay sa Deed Of Sale na Vendee ay ako. Puwede po bang gagawa ako ng Deed Of Sale na ako ang Vendor, kahit hndi pa nakapangalan sa kin ang CR ng motor? I mean, di pa nata-transfer sa pangalan ko? Para kapag may bibili na, ibibigay ko pareho yung DoS na ang Vendor ay first owner, at ako ang nakalagay na Vendee, at ang gagawin kong DoS na ang nakalagay na Vendor ay pangalan ko, so bale dawalang DoS ang ibibigay ko sa buyer.

  53. Tanong ko lang po..bumili kami ng motor ng boyfriend ko sa pinsan nya who is the third owner. Yung deed of sale is nakapangalan sakin yung motor..tapos naghiwalay na kami ng boyfriend ko. Notarized na yung deed of sale kaso binigay ko sa boyfriend ko yung original na deed of sale na walang naiwan sakin na xerox copy. Gusto kong ideclare na lost yung original na deed of sale namin ng pinsan nya kase baka ipalipat nya sa pangalan nya yung bagong deed of sale dahil nga pinsan nya yung binilhan namin. Nasa akin din lahat ng original copy ng rehistro ng motor. Ang nasa ex-boyfriend ko ay mga xerox copy ng mga naunang deed of sale at rehistro..mabibenta nya ba ang motor kahit nasa akin ang original na copy ng rehistro at nakapangalan sakin ang motor? Pwede ba sila gumawa ng pinsan nya ng bagong deed of sale?
